Terms and Conditions (E-Commerce)
Introduction
These Terms of Purchase (“Terms”) set out how you (the User) can make purchases from our Site. Please read them carefully. We pride ourselves in providing a high level of customer service and ensuring that you are clear in respect of all your rights relating to your purchase. Ahead of making any purchase you will be asked to tick a box on our Site which says, “I Accept the Terms and Conditions of Sale.” In ticking that box, you will be accepting the terms set out here.
We are based in the UK, and our Terms of Purchase are governed by UK legislation.
It is always our aim that you will be fully satisfied with your purchase. Should you have any questions about your purchase we will be happy to assist.
Services
All services are provided by Claire Diplock
Claire Diplock provides Online Colour Analysis and Styling Consultations for women.
All consultations are conducted online via Zoom.
All consultations are intended for educational and personal colour and styling purposes only.
The services provided under these Terms include:
a) 30 Minute Mini Colour Analysis Consultation –
A shorter introductory consultation applying a maximum of 5 digital colours utilising ‘Glow In Colour’ platform, designed to provide an overview of your best colours and likely seasonal palette (i.e. either Autumn, Spring, Summer or Winter)
b) 90 Minute Colour Analysis Consultation –
A comprehensive colour analysis consultation applying full set of digital drapes utilising ‘Glow In Colour’ platform, designed to provide an overview of your best colours and likely seasonal palette (i.e. either Autumn, Spring, Summer or Winter); personalised recommendations, personality quiz, and a digital or physical colour fan.
Within three business days of the consultation, you will receive a written report (pdf) by email summarising the results of the analysis.
c) 2 Hour 30 Minute Colour Analysis & Body Shape Styling Consultation –
A full consultation combining seasonal colour analysis with personalised body shape and styling guidance, including recommendations for clothing shapes, proportions, styling techniques, and wardrobe confidence.
It includes a comprehensive colour analysis consultation applying full set of digital drapes utilising ‘Glow In Colour’ platform, designed to provide an overview of your best colours and likely seasonal palette (i.e. either Autumn, Spring, Summer or Winter); personalised recommendations, personality quiz, and a digital or physical colour fan.
Within three business days of the consultation, you will receive a written report (pdf) by email summarising the results of the colour and style analysis (please note that this does not include sourcing new clothes and/or creating a mood-board, however this is an optional add-on service)
Should you have any specific goals or aims in mind which are not listed above then these will need to be agreed in advance.
Once payment has been completed you will receive an email requesting a passport-style photo taken in natural day light without make-up, this will need to be returned by email or WhatsApp 48 hours in advance of our call, so that we can make the most of the consultation.
2. Purchase Terms for Service
If you purchase as a consumer, rather than a business, then should you change your mind following your purchase you are entitled to a refund within the first 14 days of booking. Should you receive any element of the service prior to requesting a refund then any refund will be issued pro-rata for the services provided.
All fees are charged in advance. VAT is not charged and there are no additional expenses unless you are outside of the UK and postal charges may apply when sending a physical fan and also if you choose to purchase a digital fan or physical fan at the end of the ‘30 Minute Mini Colour Analysis Consultation’ or additional fans for other services.
Full payment is required at the time of booking to secure your appointment date and time.
All consultations are conducted online via Zoom. Appointment times are displayed in your local time zone at the time of booking.
Once your booking has been confirmed, you will receive a confirmation email containing your appointment details, zoom information, and instructions for submitting photographs and questionnaire prior to your consultation.
3. Photographs & Preparation
To ensure the most accurate colour analysis possible, clients are required to submit
a) passport-style photo of head and shoulders
b) photo of eyes
Photographs should:
Be taken in natural daylight
Be makeup-free (or minimal eye makeup unless otherwise advised) and have no fake tan
Be unfiltered and unedited
Clearly show natural hair colour and facial features
Failure to provide suitable photographs may affect the accuracy of the consultation results. In some cases, the consultation may need to be rescheduled.
4. Cancellation and Postponement
Should you need to cancel or postpone your consultation for any reason, notification should be made in writing to claire@coloursandcurves.uk
Where cancellation or postponement is made with less than 24 hours before the consultation a cancellation fee will apply; this will be 100% of the total cost of the services.
If in the unlikely event that I (Claire Diplock) as the provider need to cancel, you will be notified as soon as is reasonably practical and any monies that have been paid to date will be returned to you via BACS transfer within 14 days of the confirmed cancellation.
5. Refunds
As you are booking for a specific date and time, no refunds are provided if you change you change your mind or cannot attend. However, you can postpone your appointment time provided that sufficient notice is given.
I am committed to providing you with a high-quality service that is both efficient and effective. Should you have any complaints in relation to any aspect of our service, please contact [Claire Diplock and claire@coloursandcurves.uk . I agree to investigate your complaint carefully and promptly and take reasonable steps to resolve it.
Refunds will be provided in accordance with your statutory rights.
1. Disclaimers
It is important that you are aware that the consultation is reliant on receiving a decent quality passport-style photo image supplied by you. Delays in provision of images will not stop the services from being provided, however, any failure to provide images on time, or at all, will significantly limit the effectiveness of any services provided. Should you have any specific goals or aims in mind for your account which are not listed above then these will need to be agreed in advance.
Whilst many clients experience more clarity around their discovering their best colours and styles to wear because of our services, we offer no guarantees. Each person and business is different and results may vary.
All services provided are limited to a specific period which will be agreed in advance with a specific start and end date confirmed.
All services are performed by Claire Diplock. No services are outsourced.
2. Intellectual Property Rights
I retain all copyright in any document prepared while conducting any services on your behalf. Should you wish to use the document for additional purposes a licence fee can be agreed.
3. Communication
Communication with clients will be via email or telephone unless otherwise agreed in advance. Electronic communications are not secure, and I cannot be held responsible for damage or loss caused by viruses. My usual business hours are [9am until 5pm, Monday to Friday]. Outside of these times responses to any communications may not be read or responded to. Please be aware that as part of the content strategy for my business, social media posts may be uploaded to social channels outside of these hours.
4. Data Protection
We are committed to protecting your data.
Your privacy and the protection of your personal data is important to me, and it will be handled in the following way:
a) Apart from as outlined below, your data will only be used and processed in connection with the performance of the services listed above.
b) Your personal data will be kept confidential and will never be shared with unconnected third parties. It will be shared with third parties such as an accountant to allow them to perform accountancy functions.
c) Your data will be always kept secure and only stored electronically on devices which are password protected.
d) To ensure that the data held is accurate, all data will be obtained from you directly.
e) Your data will be stored for the minimum number of years following completion of the services to allow compliance with insurance obligations; and
f) All data collected will be limited to that which is necessary to allow the services to be performed.
5. Confidentiality and Retention of Information
Communications between us are confidential. I will take all reasonable steps not to disclose personal information about you and your business save for in circumstances as required by law or by me to perform the internal operations of my business, such as disclosure to an accountant.
Documents and information in relation to your matters will not be held longer than required by insurance provider obligations.
6. Limitation of Liability
Services are provided to you with reasonable care and skill. Forseeable risks which could arise include e.g. the loss of internet connection and or loss of access to the ‘Glow In Colour’ digital colour platform.
I will take all steps to avoid such an occurrence and any liability to you is limited to the amount of any fees paid.
There will not be no liability to you for any delay or failure to perform our obligations if the delay or failure is caused by circumstances outside my reasonable control.
7. Third Party Rights
No person other than the person provided with a copy of these Terms of Business shall be deemed to have the benefit of the services or have any rights to enforce or rely on any of the terms.
8. Applicable Law
These Terms of Business are my standard terms and conditions of business and should always be construed in accordance with the laws of England & Wales.
The courts of England & Wales will have exclusive jurisdiction in relation to any claim, or dispute arising out of this engagement or any matter arising from it.
